Handover record for a holiday flat: what applies with no handover

Key points

Handover record for a holiday flat: what applies with no handover

Holiday lets rarely have a handover in the classic sense. In place of a signed Übergabeprotokoll (handover inspection record) comes your own dated capture of the condition.

With self check-in there is nobody to countersign. That is no disadvantage, as long as the capture is independently dated and shows the condition in full.

German law of obligations, §§ 280, 249 BGB

In 60 seconds

1

A jointly signed Übergabeprotokoll practically never exists on short stays, because self check-in is the norm.

2

That does not change the burden of proof. You still have to show the damage arose during the stay.

3

The independent timestamp takes the place of the signature. It evidences the point in time that a countersignature would otherwise have evidenced.

4

The capture has to be complete. What was not captured does not exist in a dispute, and hobs, mattresses and floors are routinely left out.

5

The right rhythm is the guest turnover, not the season. Only then can damage be attributed to one booking.

Legal framework

The burden of pleading and proving breach, loss and amount falls on the claimant. No particular form of documentation is prescribed; what matters is whether the condition at a given point in time can be established traceably.

Common mistakes

Waiting for a signature

With self check-in there is none. The timestamp takes its place.

Capturing once per season

Then damage cannot be attributed to any one booking.

Capturing only the living areas

Hobs, mattresses and floors are exactly the expensive omissions.

What to do next

1

Capture the full condition at every guest turnover. Do it with BildProof, about two minutes a room

2

Explicitly include the hob, mattresses, floors and the number of keys.

3

Store captures so that the time and their integrity remain evidenced.

Frequently asked questions

Do I need the guest's signature?

It would be useful, but with self check-in it is unobtainable and it is not prescribed either. What matters is that the condition at a given time can be established traceably. An independent timestamp performs that function.

Is it enough if my cleaner does the capture?

Yes, provided it is complete and the time stays evidenced. Who captures matters less than when it happened and that it was not altered afterwards. It works best established as a fixed part of the end-of-stay clean.

How often must I capture?

At every guest turnover. Only then can damage be attributed to a particular booking. A capture at the start of the season evidences only that something happened sometime between March and October, and no claim can rest on that.
